Experts analysed the current situation and outlook for interlocking
.SHAREBarros Silva Varela & Vigil brought together a group of experts in competition law to analyse the main implications of the recent ruling 202/2025 by the Competition Tribunal and the approval by the National Economic Prosecutor's Office of the Codelco-SQM joint venture.
The meeting was held at the firm's offices in the El Golf, where Michael Jacobs, Andrés Osorio and José Manuel Bustamante reviewed the comparative experience and background that led to the incorporation of interlocking into the law in 2016, the economic effects it may have on the market and on the operation of companies, and the implications for corporate governance.
Michael Jacobs is a lawyer from Georgetown University, a researcher at the UAI's Centre for Competition (CeCo), a former advisor to the FNE, and author of the report "Combating Anticompetitive Interlocks: Section 8 of the Clayton Act as a Template for Chile and Similar Emerging Economies,‘ published in October 2013, one of the reports that gave rise to the interlocking rule incorporated into DL 2011 in 2016. Michael has been considered ’a key player in the law that sanctions interlockings in Chile" (DF, 15 January 2022).
Andrés Osorio is an economist from UC, holds an MPA-EPM from Columbia University, and is a partner at Econsult, where he leads the Competition and Regulation area. He is also a professor in the Master's in Applied Economics programme at UC.
José Manuel Bustamante is a partner at Barros Silva Varela & Vigil and leader of the Competition and Regulated Markets Group. He is a professor of Economic Law and Corporate Governance at the UC and an advisor to UC’s Competition Programme.
